These Terms of Service ("Terms") are a binding agreement between you and NabsFit. By creating an account or using the NabsFit mobile application, website, or related services (together, the "Services"), you agree to these Terms. Please read them carefully, alongside our Privacy Policy.

01. Acceptance of these terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced in them. If you do not agree, please do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02. Eligibility

You must be at least the minimum age required in your jurisdiction (for example, 16 or 18) to use the Services. By using NabsFit, you represent that you meet this requirement and that the information you provide is accurate and complete. If you are under the age of majority in your jurisdiction, you may only use the Services with the consent and supervision of a parent or legal guardian.

03. Your account

To use certain features you will need an account. You are responsible for:

• Providing accurate information and keeping it up to date.
• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.

Please notify us immediately at [email protected] if you suspect unauthorized use of your account. We are not liable for losses caused by unauthorized use that results from your failure to safeguard your credentials.

04. Use of the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms. You agree not to:

• Use the Services for any unlawful, harmful, or fraudulent purpose.
• Copy, modify, reverse-engineer, or create derivative works of the Services.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems.
• Use bots, scrapers, or automated means to access the Services without our permission.
• Resell, sublicense, or commercially exploit any part of the Services.

05. Community & conduct

NabsFit includes community and sharing features built around faith and encouragement. When participating, you agree to act with respect and integrity. You may not post or share content that is:

• Harassing, hateful, threatening, or discriminatory toward any person or group, including on the basis of religion or belief.
• Obscene, defamatory, deceptive, or infringing on others' rights.
• Spam, advertising, or solicitations not authorized by us.
• Harmful to minors or otherwise unlawful.

We may review, moderate, or remove content and may suspend accounts that violate these standards, at our discretion.

06. Not medical, financial, or pastoral advice

This is one of the most important parts of these Terms. NabsFit provides tools, information, and content for general informational and motivational purposes only.

07. Subscriptions & payments

Some features require a paid subscription. By purchasing a subscription you agree to the price and billing terms presented at checkout. Key points:

• Billing: Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
• Payment: Purchases made through an app store are processed and governed by that store's terms.
• Cancellation: You may cancel at any time; access continues until the end of the current paid period.
• Refunds: Except where required by law, fees are non-refundable.
• Price changes: We may change prices with reasonable advance notice.

08. Your content

You retain ownership of the content you create or upload, such as journal entries, prayers, posts, and logs ("User Content"). By submitting User Content, you grant NabsFit a worldwide, non-exclusive, royalty-free license to host, store, display, and use it solely to operate and improve the Services and to provide the features you use. You are responsible for your User Content and confirm you have the rights to share it.

09. Our intellectual property

The Services, including all software, design, text, graphics, logos, and the NabsFit name and brand, are owned by NabsFit or our licensors and are protected by intellectual-property laws. Except for the limited license granted to you, these Terms do not transfer any rights in our intellectual property to you.

10. Third-party services

The Services may link to or integrate with third-party products (such as health trackers, bank-linking providers, and app stores). We do not control and are not responsible for those services, and your use of them is governed by their own terms and policies.

11. Suspension & termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the Services ends, though provisions that by their nature should survive (such as ownership, disclaimers, and limitations of liability) will remain in effect.

12. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that results obtained from using them will be accurate or reliable, to the maximum extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, NabsFit and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless NabsFit and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

15. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Texas, unless applicable law requires otherwise.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you within the app or by email. Your continued use of the Services after the changes take effect means you accept the updated Terms.
